The Workmen Compensation Act, 1923 (the “Act”) make compulsory for the employer to make payment of compensation to workmen for any injury or death caused while performing his duties. According to the definition of employer and managing agent as provided under the Act, the liability under the Act shall be on the body or person for whom the workmen was working while he sustained injury or his death was caused. Definition of managing agent provided in this Act has exclude an individual subordinate to an employer, whereas it means any person appointed or acting as the representative of another person for the purpose of carrying on such other person’s trade or business.
