This Letters of Administration and Succession Certificates Act, 2021 is enacted for providing a speedy, efficacious, and transparent mechanism for the issuance of letters of administration and succession certificates. A Letter of administration/certificate of succession is issued when an application is made for claiming the charge of the left property of a deceased person being legal heirs in respect of his movable or immovable property. After the commencement of Letters of Administration and Succession Certificates Act, 2021, National Database and Registration Authority (“NADRA”) will issue such certificates while previously a the Civil Courts were empowered to grant these Succession Certificates.

NADRA may notify any of its existing offices as ‘Succession Facilitation Unit’, at such place or places as it may deem appropriate. Application may either be made by a legal heir, having authority from all other legal heirs of the deceased person, in the prescribed manner before NADRA within whose jurisdiction the deceased ordinarily resided at the time of his death, or within whose jurisdiction any property or asset of the deceased is located. On the receipt of such application, NADRA should processes application following the FRC (Family Registration Certificate). Such application must append with it:

i) Death certificate of the deceased ;
ii) List of the legal heirs and copies of the NICs (National Identity Cards);
iii) Authorization if an application is made by a single legal heir on behalf of all others; and
iv) Details of immovable and immovable property in respect of which Letter of administration/Succession certificate is applied for.

A notice must be made to the public which shall be published

• Through an online web portal; or
• One English language and one Urdu language daily national newspaper.

If no objection is raised within fourteen days of publication of such notice, the Authority shall do biometric verification of all the legal heirs. After completion of due process, a letter of administration or certificate of succession is issued that contains in favor of all legal heirs with their respective shares.
