This Act may be called the Illegal Dispossession Act, 2005 and is enacted to protect the lawful owners and occupiers of immovable properties from their illegal or forcible dispossession by the property grabbers. It extends to the whole of Pakistan. The offence under this Act shall be non-cognizable and triable by the Court of Session. This Act provides the procedure of investigation and the provisions of the Code of Criminal Procedure, 1898 shall apply to the proceedings under this Act. Whoever contravenes the provisions of this Act shall, without prejudice to any punishment to which he may be liable under any other law for the time being in force, be punishable with maximum term of imprisonment of ten years and with fine. The victim of the offence shall also be compensated in accordance with the provision of section 544-A of the Code of Criminal Procedure, 1898.
