The Federal Government issued the Trade Marks Rules, 2004 under the rule-making power in section 132(1) of the Trade Marks Ordinance, 2001. The Rules set out the framework for trademark practice, filing and processing of applications and notices, changes in proprietorship, consent for assignments of certification marks, oppositions to alterations, renewal and alteration procedures, and the fee tables in the first schedule. They also cover how and when applications are published, what particulars are recorded in the Register, and the conditions for registering letter and numeral based marks. An Advisory Committee (under section 95) is constituted by the Federal Government on recommendations of the association named in the seventh schedule, and the Rules include requirements for registering trade mark agents. Committee members serve two year terms and select a chair and vice-chair, with vacancies filled by election. The 2004 Rules replaced the earlier Revised Trade Marks Rules, 1963.
