The Punjab Partition of Immovable Property Act, 2012 was enacted on 5th January 2013 by the Punjab Provincial Assembly in order to reform and amend the laws related to the Partition of Immovable Property, other than agricultural land across the province of Punjab. It expedites partition of immovable property, its process and matters related therewith. Under this Act Immovable Property means an immovable property, other than agricultural land or land subservient to agriculture, jointly owned by two or more persons. The Punjab Partition of Immovable Property Act, 2012 has repealed the Partition Act of 1893.
This Act may be cited as the Punjab Partition of Immovable Property Act, 2012 and is enacted to amend and reform the law relating to expeditious partition of immovable property and to provide for ancillary matters. It shall extend to whole of the Punjab. Nothing contained in this Act shall be deemed to affect any law providing for the partition of agricultural l and or l and subservient to agriculture. The provisions of the Code of Civil Procedure, 1908 shall apply to any proceedings under this Act. The Lahore High Court may issue instructions necessary for purposes of the Act and the Court [Court of original civil jurisdiction competent to entertain and decide suits for partition of immovable property] shall dispose of the suit under this Act within six months from the date of the institution of the suit.
