This Act may be called Price Control and Prevention of profiteering and Hoarding Act, 1977 and is enacted to provide for price control and prevention of profiteering and hoarding. It is applicable to whole of Pakistan. The Federal Government may delegate power for the purpose of this act to officer or authority subordinate to the Federal Government or Provincial Government or such officer or authority subordinate to a Provincial Government. No person shall sell or re-sell any essential commodity at a price which is higher than the maximum price fixed by the Controller General. The Federal Government may make orders for the matters listed under Section 3 and any person who contravene, abets and attempts to contravenes shall be punished with imprisonment for a term, which may extend up to three years and with fine up to one lac rupees. If the person contravening an order is a company or other body corporate or a partnership or other body of individuals, every director, manager, secretary, member or other officer or agent be deemed to be guilty unless he proves that the contravention took place without his knowledge or that he exercised all due diligence to prevent such contravention. Offences punishable under this Act shall be tried by a Magistrate of the First Class in accordance with Sections 262 to 265 of the Code of Criminal Procedure, 1898. No order made by any authority other than a Court in exercise of any power under this Act shall be called in question in any Court. Its schedule provides the list of Officers, which are authorized to exercise the power of the Controller General of prices and supplies under clause a Sub Section (2) of Section 3.
