This Act may be called as the Arbitration Act, 1940 and is enacted to consolidate and amend the law relating to Arbitration in Pakistan. It extends to the whole of Pakistan. The arbitration agreement must be in writing and all the parties to an agreement must agree to settle their matter through arbitration. It provides different types of arbitration. All the provisions of the Limitation Act, 1908 shall apply to arbitrations as they apply to proceedings in Court. The arbitrator has to be appointed by the Court in cases where the parties have agreed to get their disputes settled through arbitration. The decision of the arbitrator is called award.
