The old law for creating a trust in Pakistan was Trust Act, 1882 which was initially a federal statue and was adopted by provinces after devolution of powers to provinces in 18th amendment of the Constitution. In the year 2020 the provinces and the federation enacted new laws for the purposes of catering effective administration, financial monitoring and evaluation of the trusts. The following laws deal with the creation of trust in Pakistan.
i)The Punjab Trusts Act, 2020;
ii)The Punjab Trusts (Amendment) Act, 2020;
iii) The Islamabad Capital Territory Trust Act, 2020;
iv)The Balochistan Trust Act, 2020;
v)The Khyber Pakhtunkhwa Trust Act, 2020; and
vi)The Sindh Trusts Act, 2020
In case a trust has to accept donations from the public the same is also required to be registered under charity law of the respective province.
