DHA City Decision Full Text

DHA City Verdict is a l and mark judgement given by Honourable Supreme Court of Pakistan in the Human Rights case No. 96122 of 2018. The Honourable Supreme Court came to the rescue of more than eleven thous and helpless plot holders who had been shuttling in the h ands of mighty institutions for above a decade for their legitimate and bonafide rights. The Apex Court came to the rescue of the allottees of Defense Housing Authority “DHA” who were running from pillar to post to get justice. The Apex Court observed that the matter has grossly been mish andled in order to gain personal benefit by officers and officials of bother sides involved in this transaction.  The key points of the judgment are as follows:

  1. DHA City shall be a project of DHA and shall constitute its Phase XIII, DHA.
  2. DHA shall be responsible for its development in a manner and of a quality equivalent to or better than its existing phases in DHA within six years. DHA would purchase the additional l and required for implementation of the project.
  3. DHA shall intimate the affectees informing them that the details of due installments as well as development charges which shall not be unreasonable.
  4. Existing documentation relating to allotment shall be changed and DHA shall replace it with its own files, documentation and allotment letters.
  5. The agreements and MoUs signed by DHA with private companies were held to be vague, self contradictory, non specific and uncertain, The Apex Court disregarded the same as their validity was highly questionable.
  6. DHA was directed  to furnish the bank guarantee in respect of the amounts deposited in frozen accounts.
  7. All the orders of Civil Courts restraining the parties from doing any development work in the areas which constitute part of the afore noted project were vacated keeping in view that such order would complicate matters and disturb the time frame, milestones and mechanisms put in place.
