The Punjab Prohibition of Kite Flying (Amendment) Act, 2024 was enacted to bring certain amendment in the Punjab Prohibition of Kite Flying Ordinance, 2001 as previously amended by Punjab Prohibition of Kite Flying (Amendment) Act, 2009. Previously the law provided that Nazim (as were appointed under Local Government Ordinance, 2001) of a concerned district , with prior approval of the Government could allow kite flying and sale of kite materials for fifteen days. However, the Kite Flying (Amendment) Act, 2024 has omitted this provision which means that now no one give such permission and the provision of allowing kite flying for even fifteen days is no more in field. The new amendment expressly mentions that all the activities related to kite flying shall be banned. In addition to the provision in the law which provided for registration of kite manufacturers, establishment of kite flying association and procedures of taking permission of kite flying were totally omitted making a trade and business totally banned against provisions of fundamental rights contained in Article 18 of the Constitution which pertains to the freedom of trade. The section pertaining to the power to make rules under the old law has also been omitted making the existing rules of 2007 redundant. Prohibition of Kite Flying (Amendment) Act, 2024 has expressly banned even the transportation of kites and its related material from one place to another and the punishment for such activities have been made more stringent. The law has even not spared young children against such activities.
